Welcome to TalkYouNow. By creating an account or using our service, you agree to these Terms of Service. Please read them carefully.
1. The service
TalkYouNow is a platform that lets creators offer paid 1:1 video calls to their audience through a public booking page and payment system.
2. Account
You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. You must be at least 18 to create a creator account.
3. Payments and fees
Payments are processed by our providers (including Stripe). A platform fee applies to each transaction: 12.5% via automatic payout, or 19% via manual payout (paid out once 100 in your account currency, EUR or USD, is reached). Applicable taxes remain the creator's responsibility.
4. Bookings and cancellations
Creators set their availability, offers, and prices. Fans book and pay in advance. Refund and cancellation terms are the creator's responsibility, subject to applicable law.
5. Creator obligations
Creators agree to honor booked calls, deliver a service consistent with their offers, and not use the platform for illegal or deceptive purposes.
6. Creator tax obligations
The Creator is solely responsible for declaring, paying, and complying with all tax, social-security, accounting, and administrative obligations applicable to the income earned through the services offered via TalkYouNow.
It is in particular the Creator's responsibility to determine — based on their personal situation, professional status, country of residence or establishment, and the location of their clients — whether their income is subject to reporting obligations, VAT, sales taxes, social contributions, or any other tax or regulatory obligation.
TalkYouNow provides a technical infrastructure for matchmaking, booking, and payment, and does not provide the Creator with any tax, legal, or accounting advice.
The Creator agrees to provide accurate and up-to-date tax information whenever required by TalkYouNow, Stripe, or any competent authority.
TalkYouNow reserves the right to transmit to the competent tax or administrative authorities any information required by applicable law.
7. Creator status
The Creator acts in their own name and under their own responsibility when offering and providing a call, consultation, or any other service to a Client.
TalkYouNow is not the provider of the call or consultation booked by the Client and is not a party to the performance of the service between the Creator and the Client.
The Creator sells and delivers their service. TalkYouNow provides the software tool, booking, and technical payment collection.
The Creator acts in their own name and on their own behalf.
8. Indemnification related to Creator obligations
To the extent permitted by applicable law, the Creator agrees to indemnify and hold TalkYouNow harmless against any claim, demand, reassessment, penalty, sanction, tax, contribution, cost, or expense directly resulting from the Creator's failure to comply with their tax, social-security, accounting, administrative, or regulatory obligations.
This obligation does not apply to consequences directly resulting from TalkYouNow's own fault or breach.
9. Prohibited use
Prohibited: any illegal, hateful, fraudulent content, sexual content involving minors, or content infringing others' rights. We may suspend any account in violation.
10. Intellectual property
You keep the rights to your content. You grant us a limited license to display it as part of the service. The TalkYouNow brand and software remain our property.
11. Limitation of liability
The service is provided "as is". To the extent permitted by law, TalkYouNow is not liable for indirect damages arising from use of the service.
12. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these Terms.
13. Changes
We may update these Terms. For material changes, we will notify you. Continued use means acceptance.
